These Terms of Service (“Terms”) govern your use of EPA 608 Pro (the “App”) and epa608pro.com (the “Site”), provided by Michael Scott (“we,” “us,” or “our”). By downloading, accessing, purchasing, or using the App or Site, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the App or Site.

Purpose of the App

EPA 608 Pro is an educational study tool designed to help users prepare for EPA Section 608 technician certification tests. The App may include Core, Type I, Type II, Type III, and Universal study material; practice questions; explanations; flashcards; progress tracking; weak-area review; and certification exam simulations.

Independent Exam Preparation

EPA 608 Pro is an independent product. It is not affiliated with, endorsed by, approved by, or sponsored by the United States Environmental Protection Agency, any EPA-approved certifying organization, any testing provider, or any HVAC school or employer.

EPA 608 Pro does not administer official certification tests, issue certification cards, verify technician status, or grant any license or credential. Official Section 608 certification requires passing an appropriate test administered by an EPA-approved certifying organization.

Educational Disclaimer

The App and Site are provided solely for education and exam preparation. Questions and explanations are original study materials and are not actual confidential exam questions. They are not guaranteed to match the exact wording, selection, difficulty, timing, administration rules, or scoring procedures used by a particular testing organization.

Use of the App does not guarantee that you will pass an examination, receive a certification, satisfy an employer requirement, qualify to perform regulated work, or remain compliant with applicable law.

No Legal, Regulatory, Safety, or Professional Advice

The App may discuss refrigerants, recovery and recycling practices, appliance classifications, safety procedures, environmental regulations, recordkeeping, leak requirements, shipping, cylinders, and related subjects. This information is general educational material and is not legal, regulatory, engineering, workplace-safety, or professional advice.

Always follow current federal, state, and local law; official EPA materials; the requirements of your certifying organization; manufacturer instructions; safety data sheets; employer procedures; and applicable industry standards. Do not rely on the App as a substitute for qualified supervision, hands-on training, required protective equipment, or professional judgment.

Content Scope and Changes

Regulations, standards, refrigerant rules, approved uses, testing topics, and provider manuals may change. Some material may be labeled as supplemental current-law or provider-manual content and may not appear on every official examination.

We work to keep the App useful and accurate, but errors, omissions, outdated information, or differences between testing providers may occur. You should confirm current requirements using official EPA resources and information supplied by your testing organization.

Subscriptions and Paid Features

The App may offer free content, paid features, subscriptions, trials, introductory offers, or other premium access. Availability, pricing, billing periods, trial length, and included features may vary by platform, country, account, or time and will be shown before purchase.

Purchases may be processed by the Apple App Store, Google Play, RevenueCat, or another authorized platform. Your payment, renewal, cancellation, and refund rights are also governed by the terms of the platform through which you purchased access.

Subscriptions may renew automatically unless canceled before the renewal date through the applicable platform account settings. Deleting the App does not cancel a subscription.

Free Trials and Promotions

If a free trial or promotional offer is available, its duration, eligibility, price after the offer, and renewal terms will be displayed at purchase. Unless canceled before the trial or promotional period ends, access may convert to a paid subscription under the terms presented at checkout.

We may modify or discontinue offers, pricing, and subscription options, subject to platform requirements and applicable law.

Refunds

Refund requests for purchases made through Apple or Google are generally handled by the applicable platform under its refund policies. We do not control platform refund decisions.

Your Responsibilities

You are responsible for your study decisions, exam registration, test-provider requirements, certification status, workplace conduct, and compliance with applicable laws and safety requirements. You agree to use the App only for lawful, personal, and educational purposes.

Intellectual Property

The App and Site, including their design, software, branding, text, original questions, explanations, flashcards, graphics, images, and other content, are owned by or licensed to Michael Scott and are protected by intellectual-property laws.

Subject to these Terms, you receive a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the App for your own exam preparation. No ownership rights are transferred to you.

Government names, laws, regulations, and publicly available regulatory materials remain the property of their respective owners or are subject to the rights applicable to those materials. References to “EPA” and “Section 608” identify the subject matter of the independent study product and do not imply endorsement.

Accounts and Progress Data

The App may store scores, progress, missed questions, flashcard activity, simulator history, and related information locally or through supported account or synchronization services.

You are responsible for maintaining access to your device and any account credentials. We are not responsible for progress or data lost because of uninstalling the App, clearing device data, changing devices, losing account access, platform changes, backup failures, or other technical issues.

Third-Party Services

The App and Site may rely on third-party platforms and services, including Apple, Google, RevenueCat, analytics providers, crash-reporting providers, hosting services, and infrastructure providers. Their availability and operation are outside our control and may be governed by separate terms and privacy policies.

Changes, Availability, and Termination

We may update, modify, suspend, or discontinue features, questions, explanations, pricing, subscription options, or any part of the App or Site. We may restrict or terminate access when a user violates these Terms, attempts to bypass payment systems, misuses content, threatens security, or uses the service unlawfully.

You may stop using the App at any time. Uninstalling the App does not automatically cancel an active subscription.

Disclaimer of Warranties

To the maximum extent permitted by law, the App and Site are provided “as is” and “as available,” without warranties of any kind, express or implied. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the App or Site will be uninterrupted, error-free, fully accurate, secure, compatible with every device, or sufficient for any particular exam, certification, job, or regulatory purpose.

Limitation of Liability

To the maximum extent permitted by law, Michael Scott and EPA 608 Pro will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost data, lost profits, failed examinations, certification delays, employment consequences, equipment damage, refrigerant loss, regulatory penalties, or injuries arising from reliance on App content.

Your use of the App and Site is at your own risk. Some jurisdictions do not allow certain warranty exclusions or liability limitations, so portions of this section may not apply to you.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Michael Scott and EPA 608 Pro from claims, damages, liabilities, losses, costs, and expenses arising from your misuse of the App or Site, violation of these Terms, violation of law, or infringement of another person’s rights.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be interpreted as closely as legally possible to its intended purpose.

Changes to These Terms

We may update these Terms as the App, Site, or legal requirements change. Updated Terms will be posted on this page with a revised effective date. Your continued use after updated Terms become effective constitutes acceptance of the revised Terms.
